CONSENT NOTICE

We, Equation Internet Private Limited (hereinafter referred to as “Company”, “We”, “Us”, or “Our”), incorporated under the Companies Act, 2013 (CIN: U72900KA2021PTC153232), with its registered office located at 339, 5th floor, 14th B Cross Road, Sector-6 HSR Layout, Bengaluru, Karnataka, India, 560102, respects the privacy of any person who accesses or uses Our Platform (hereinafter referred to as “You”, “User”, or “Your”) and is committed to protecting Your Personal Data (defined below). This notice applies to the processing of Personal Data collected in digital form or any non-digital form which is digitised subsequently.

In order to comply with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules framed thereunder and to provide Our Services to You, We would be collecting and processing Your Personal Data. For this data collection and its processing, We need Your explicit consent.

You reserve the right to file a complaint with the Company regarding any grievances arising from the processing of Your Personal Data, which shall be directed to the Grievance Officer, as detailed in Our Policy (defined below).

Should the grievance remain unresolved through Our grievance redressal mechanism as provided in the Policy, You further retain the right to approach the Data Protection Board of India with a complaint (available here), as outlined in the provisions of the DPDP Act. Pursuant to the DPDP Act, you are required to exhaust all opportunities of grievance redressal before approaching the Data Protection Board of India.

All the capitalised terms used in this consent notice shall have the same meaning assigned to them in Company’s Privacy Policy (“Policy”).

Declaration of Understanding - Data Processing Policies:

 

  1. I understand that my Personal Data may be collected only with my valid consent, and that it may be processed only in accordance with the Policy.

  1. I agree to provide all information (collectively referred to as “Personal Data”) mentioned below to the Company during the visit, or use of, and/or registration on, Our Platform for better facilitation of Our Services, which includes, but is not limited to:

  1. Personal Data such as name of the User, mobile and telephone numbers (work and mobile), email address, postal address, gender, date of birth and age, place of birth, billing and payment-related information (bank account, mode of payment, transaction reference numbers, payment history on the Platform, debit/credit card or other payment instruments details (if any)), feedback, complaints, and service preferences of the Users, name and contact details of authorised representatives of the Users, details of documents on education, qualification, professional training, number, and photograph.

  1. Location, Log, and Device Information which shall include (i) Your IP addresses, (ii) Your geolocation information, (ii) time zone (iv) access dates and times, (v) information about Your activity on Our Platforms which shall include the sites from where You have accessed Our Platform(s), (vii) type of browser, (ix) mouse clicks, browser actions, (x) software and file names, (xi) device identifiers, (xii) preferred language, (xiii) operating systems.

  1. Information shared through free will such as through feedback(s) provided on the Platform, modification of Your content or email preferences, responses to voluntary surveys, participation in contests or special offers on the Platform, or asking Us a question through Our e-mail.

  1. Use of Local Storage Objects to store content information and preferences. Third parties with whom We partner to provide certain features on Our Platform or to display advertising based upon Your web browsing activity.

  1. Data obtained from Third Parties to provide certain parts of our Services. We may collect and disclose certain Personal Data to Third Parties and they may place or recognize Cookies, web beacons, to track your usage of the Platform. We may also receive Your Personal Data from third party social media entities. If You access the Platform through a connected service on the Platform, your Personal Data may be collected from that connected services as well.  

  1. Other Information: Any content You choose to make public on Our Platform such as comments, reviews, ratings, images, or other submissions may be viewed and used by others and by Us for promotional or commercial purposes. We are not responsible for Personal Data You voluntarily disclose through such public activities, which may also appear on third-party websites or connected social media accounts and will be deemed shared by You.

  1. We collect, use, process, store, disclose or transfer Your Personal Data in compliance with the Applicable Laws of India, for the following purposes to:

  1. perform the Services that You have contracted with Us for, including but not limited to availing of Our Services, or accessing or viewing the content on the Platform;
  2. provide other ancillary services on the Platform, such as facilitating the creation of User profiles, viewing and accessing content, processing of offer coupons/vouchers, and related customer support and engagement;
  3. contact You via email or phone call or SMS/WhatsApp and offer You Our Services, make suggestions/recommendations in relation to Our Services, impart product knowledge, offer promotional offers running on Platform, for which reasons Personal Data collected may be used;
  4. create and maintain an online account with the Platform, notify You about changes to Our Services, allow You to participate in interactive features of our Services when You choose to do so; monitor Your usage of Our Platform and Services;
  5. provide You with notices about Your account and/or subscription, including expiration and renewal notices, email-instructions, etc.;
  6. furnish Your Personal Data to service providers to the extent necessary for delivering the relevant Services to You;
  7. dispatch transaction-related communications such as welcome letters, billing reminders, and purchase confirmations;
  8. aggregated and individual, anonymized and non-anonymized data may periodically be transmitted to service providers to help Us improve the Platform and Our Services;
  9. maintain and operate internal business systems and records, including storage, maintenance and retrieval of records in physical and/or digital formats, and implementing role-based access and internal access controls;
  10. provide aggregate statistics about Users, traffic patterns, and other related information to reputable third parties, however this information when disclosed will be in an aggregate form and does not contain any of personally identifiable information;
  11. engage third-party service providers as sub-processors to support Our Services and/or business operations (including payment partners, IT/cloud vendors, customer feedback systems and professional advisors), to the extent necessary for the purposes described in this Policy;
  12. provide an enhanced and personalised User experience;
  13. analysis to improve relationships with our Users;
  14. comply with contractual, legal or regulatory obligations;
  15. manage User communications, including responding to queries, feedback, complaints and service requests received through Our Platform, email;
  16. development in products offered, which allows Us to improve and enhance the safety and security of Our Services, develop new features and products;
  17. improve Platform analytics, user experience, and optimize Our Services; or
  18. disclose pursuant to government/court orders and check any account activity in order to prevent fraudulent transactions and ensure the security.

  1. I understand that I have certain rights that I enjoy as a data principal over my Personal Data, in relation to its collection, use and processing. These rights, inter alia, relate to confirmation and access, correction and erasure, objection of processing, grievance redressal and withdrawal of consent. These rights are available to me in the manner set out in the Policy.

  1. I agree that I am of lawful age to contract as per Applicable Laws of India and I have read and understood the processing requirement with respect to my Personal Data as listed above and provide my free, specific, informed, unconditional and unambiguous consent to the above by signing on the space provided below.

  1. I understand that I have the right to withdraw my consent at any time in the manner specified under the Policy. If I need to withdraw my consent with respect to usage of my Personal Data under Company’s purview, excluding data which has already been shared with the authorities, regulators or business associates and outside the control of the Company at that time, I will inform the Company through the “Consent Withdrawal Form” as provided on the Platform.

  1. I understand that this withdrawal of consent will be implemented as soon as practicable. I also confirm that the Company, while accepting my request for withdrawal of consent, will be allowed to keep such Personal Data as required by the Applicable Laws and regulations for history and record keeping purposes for a specified period of time.

  1. By agreeing to the Privacy Policy, I signify agreement to the processing and sharing of my Personal Data with the Company now and in future in order to allow the Company to conduct business or sharing information with business associates or authorities as may be required under different regulations, laws and statues of India and outside India, or with such third parties/vendors, as may be applicable and amended from time to time.
